These Terms of Service ("Terms") govern your access to and use of the website operated by The Dreamers Co LLP ("The Dreamers Co", "we", "us", or "our") and any purchase you make through it (collectively, the "Site"). Please read these Terms carefully. By using the Site, you agree to them.


1. Acceptance of Terms

By accessing, browsing, or making a purchase through the Site, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Returns & Refunds Policy, each of which is incorporated into these Terms by reference. If you do not agree with any part of these Terms, please do not use the Site or place an order.

We may update these Terms from time to time. Any changes take effect when the revised version is posted on this page, with a new "Last updated" date. Your continued use of the Site after changes are posted means you accept the revised Terms. We encourage you to review this page periodically.

2. Eligibility

The Dreamers Co designs clothing for children aged 2 to 6 years, but our products are sold to and purchased by adults.

  • You must be at least 18 years of age and capable of forming a legally binding contract under the Indian Contract Act, 1872, to make a purchase or create an account on the Site.
  • By placing an order, you confirm that you are an adult buying on behalf of yourself or the child for whom the products are intended.
  • The Site is not directed at children, and children may not place orders or transact on the Site.
  • You agree to provide accurate, current, and complete information when placing an order or registering an account, and to keep that information up to date.

3. Products & Pricing

We sell premium Indian kidswear, including T-shirts and jogger pants in sizes 2, 3, 4, 5, and 6 (years), made from 100% interlock soft cotton and proudly Made in India.

  • Currency. All prices are listed and charged in Indian Rupees (₹) unless stated otherwise.
  • Prices subject to change. Prices are current at the time of display but may change at any time without prior notice. The price applicable to your order is the price displayed at the time we accept your order, as confirmed in your order confirmation.
  • Taxes and charges. Prices are inclusive or exclusive of applicable taxes (such as GST) as indicated at checkout. [REVIEW] Confirm GST treatment and whether displayed prices are tax-inclusive. Any applicable shipping charges are shown separately at checkout and set out in our Shipping Policy.
  • Availability. All products are subject to availability. We may add, modify, or discontinue any product, size, print, or collection at any time without notice. We make reasonable efforts to keep stock information accurate but do not guarantee that any item shown will be in stock.
  • Colour and image accuracy. We work hard to display our products and prints — including Jam, Ice Cream, French Fries, Pasta Club, and Waffle — as accurately as possible. However, actual colours, textures, and finish may vary depending on your device, screen settings, and lighting. Photographs and on-screen representations are for illustration; slight variations from the product you receive are normal and are not a defect.
  • Errors. Despite our best efforts, the Site may occasionally contain errors in pricing, descriptions, images, or availability. We reserve the right to correct any errors and to cancel or refuse any order placed based on inaccurate information, even after an order has been confirmed (see Section 4).

4. Orders, Acceptance & Cancellation

  • Your order is an offer. When you place an order, you are making an offer to purchase the selected products subject to these Terms. An automated order acknowledgement (for example, an email confirming receipt) does not constitute our acceptance of your order.
  • Our acceptance. A contract between you and us is formed only when we confirm that your order has been accepted and dispatched, or as otherwise stated in your order confirmation. We reserve the right to accept or decline any order at our discretion.
  • Refusal of orders. We may refuse, limit, or cancel an order for reasons including, without limitation: the product being unavailable, a pricing or description error, suspected fraudulent or unauthorised activity, breach of these Terms, or quantities that appear to be for resale rather than personal use.
  • Cancellation by you. You may request to cancel an order before it has been dispatched by contacting us promptly at hello@thedreamersco.com. We will try to accommodate cancellation requests, but we cannot guarantee cancellation once an order has entered processing or dispatch. Cancellations after dispatch are handled under our Returns & Refunds Policy.
  • Cancellation by us. If we cancel an order that you have already paid for, we will refund the amount charged using your original payment method, in accordance with our Returns & Refunds Policy.

5. Payment

  • Payment is processed through third-party payment service providers integrated with our Shopify storefront. By submitting payment information, you authorise us and our payment providers to charge the applicable amount, including any taxes and shipping charges, for your order.
  • You represent that you are authorised to use the payment method you provide and that the payment information you supply is accurate.
  • Orders are processed only once payment has been successfully authorised and received. If a payment is declined, reversed, or charged back, we may cancel or hold the related order.
  • We do not store full payment card details on our own systems; payment data is handled by our payment providers in accordance with their terms and applicable security standards. [REVIEW] Confirm payment provider(s) and PCI-DSS handling for the Privacy Policy.

6. Shipping & Returns

We ship across India. Details of delivery timelines, shipping charges, serviceable locations, and order tracking are set out in our Shipping Policy.

Your rights and our process for returns, exchanges, and refunds — including eligibility, timelines, and condition requirements — are set out in our Returns & Refunds Policy.

These policies form part of these Terms. In the event of any conflict between these Terms and a specific policy on a matter that policy expressly governs, that policy will prevail to the extent of the conflict. Nothing in these Terms or those policies limits any rights you have as a consumer under the Consumer Protection Act, 2019, or other applicable law.

7. Intellectual Property

All content on the Site is owned by or licensed to The Dreamers Co LLP and is protected by Indian and international intellectual property laws. This includes, without limitation:

  • the brand name "The Dreamers Co" and our tagline "Soft as clouds. Strong as dreams.";
  • our logo and the unicorn motif;
  • our original graphic prints and designs, including the Jam, Ice Cream, French Fries, Pasta Club, and Waffle artwork;
  • all product imagery, photography, illustrations, text, and the overall look and feel of the Site.

You may view and use the Site for your own personal, non-commercial purposes only. You may not, without our prior written permission:

  • copy, reproduce, modify, distribute, publicly display, or create derivative works from any of our designs, artwork, logos, the unicorn motif, brand names, or product imagery;
  • use our trademarks, brand elements, or content in connection with any product, service, or business;
  • reproduce our prints or designs on garments or other goods, whether for sale or otherwise.

All rights not expressly granted to you are reserved by The Dreamers Co LLP. [REVIEW] Confirm registered/unregistered status of trademarks and design registrations so this section can reference them accurately.

8. Acceptable Use & Prohibited Conduct

When using the Site, you agree not to:

  • use the Site for any unlawful, fraudulent, or unauthorised purpose, or in violation of any applicable law or regulation;
  • place orders using false, misleading, or another person's information, or engage in fraudulent payment activity;
  • purchase products for commercial resale or distribution without our prior written consent;
  • copy, scrape, harvest, or extract data or content from the Site using automated means (such as bots, crawlers, or spiders) except as permitted by standard search-engine indexing;
  • attempt to gain unauthorised access to, interfere with, damage, or disrupt the Site, its servers, or any connected systems or networks, including by introducing viruses or malicious code;
  • reverse engineer, decompile, or otherwise attempt to derive the source code of any part of the Site;
  • infringe our intellectual property rights or those of any third party; or
  • use the Site in any way that could harm, disable, overburden, or impair it, or interfere with any other party's use of it.

We may suspend or terminate your access to the Site, cancel orders, and take any other action available to us at law if we reasonably believe you have breached these Terms.

9. Disclaimers

  • We provide the Site and our products with reasonable care, but the Site is provided on an "as is" and "as available" basis. To the extent permitted by law, we do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components.
  • Our products are intended as everyday children's clothing, made to be lived in. Please follow any care instructions provided with the garments to keep them in good condition.
  • Safety note for caregivers. As with all children's clothing, adult supervision is recommended, and garments should be chosen appropriately for the child's age and size. [REVIEW] Consider adding any product-specific safety, care, or choking-hazard guidance with legal/compliance input.
  • Nothing in this section excludes or limits any warranty, condition, or right that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Dreamers Co LLP, its partners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses arising out of or relating to your use of (or inability to use) the Site or any products purchased through it.
  • Our total aggregate liability arising out of or relating to any order will not exceed the amount you actually paid for the product(s) giving rise to the claim.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable Indian law (including your statutory consumer rights). 11. Indemnity

You agree to indemnify and hold harmless The Dreamers Co LLP and its partners, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party. 12. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them, the Site, or any purchase (including non-contractual disputes) are governed by and construed in accordance with the laws of India. Subject to any non-waivable consumer rights, the courts at Mumbai, Maharashtra, India will have exclusive jurisdiction over any such dispute.

13. Severability & Waiver

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

14. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Returns & Refunds Policy, constitute the entire agreement between you and The Dreamers Co LLP regarding your use of the Site and supersede any prior agreements or understandings on that subject.
